In most jurisdictions, customs law is particularly strict, allowing goods to be seized and penalties imposed even in cases where there has been no deliberate attempt to avoid taxes or breach prohibitions. A real risk to businessmen and senior executives is Customs’ ability to instigate criminal proceedings in cases where they perceive that there has been“recklessness” on the part of a director, partner or employee of the company.
